These Terms & Conditions ("Terms") are an agreement between you and Librix ("Librix", "we", "us", or "our"). They govern your use of the Librix mobile app, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms, our Community Guidelines, and our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use Librix
You must be at least 13 years old, or the minimum age of digital consent in your country if it is higher, to create an account. If you are under 18, you must have a parent's or guardian's permission. You must also have their permission before meeting anyone in person through the marketplace. You may not use the Service if we have previously banned you or if you are barred from using it under applicable law.
2. Your account
You can sign up with an email address and password or with Google. You agree to give accurate information, keep your password confidential, and tell us promptly at support@librix.app if you suspect unauthorized use. You are responsible for all activity under your account. Each account is for one person and may not be sold or transferred.
3. The Service
Librix lets you catalog books, keep notes and bookmarks, organize shelves, set reading goals, write reviews, share a library with family members, chat with other readers, and list books to swap or give away. Book details and cover images come from third-party sources and may be incomplete or inaccurate. Librix is free to use and currently has no paid features or in-app purchases.
4. Your content
"Your Content" means anything you add to the Service, such as notes, reviews, ratings, photos, listings, and messages. You keep ownership of Your Content.
You give Librix a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and adapt Your Content (for example, resizing images) as needed to operate and improve the Service. The license also covers showing it to the people the feature is meant for: reviews and listings are public, family content is visible to your family, and messages are visible to their recipients. The license ends when you delete the content or your account. The exceptions are copies already shared with other users, such as messages you sent, and copies we must keep by law.
You confirm that you have the rights to Your Content and that it does not violate these Terms, the Community Guidelines, or anyone else's rights.
5. Objectionable content and abusive users: zero tolerance
There is no tolerance for objectionable content or abusive users on Librix. You must not post, send, or share content that:
- is illegal, or promotes illegal activity;
- harasses, bullies, threatens, or intimidates anyone;
- is hateful, or discriminates on the basis of race, ethnicity, religion, disability, gender, sexual orientation, or any other protected characteristic;
- is sexually explicit or pornographic;
- sexualizes or exploits minors in any way;
- is graphically violent;
- is spam, a scam, or fraudulent;
- infringes someone's intellectual property or privacy, including posting another person's private information.
The full rules are in our Community Guidelines. You can report content or users to us at support@librix.app. We review reports within 24 hours. We may remove objectionable content and suspend or permanently ban the users responsible, without notice. Where the law requires it, we report illegal content, including child sexual abuse material, to the authorities.
6. Marketplace: swaps and giveaways
Librix lets users list books to swap or give away and arrange exchanges with each other.
- Librix is not a party to any exchange. We do not own, inspect, or guarantee listed books. We do not verify users, and we are not responsible for the condition, delivery, or legality of any item, or for anything users say or do.
- No payments through Librix. Librix does not process payments. Any payment you agree with another user is entirely between the two of you, at your own risk.
- Meet safely. Meet in public places, tell someone where you are going, and do not share financial information. Minors should bring a parent or guardian.
- You may list only books that you own and are allowed to give away. You may not list counterfeit or pirated copies, or anything other than books.
Any dispute about an exchange is between you and the other user. To the extent permitted by law, you release Librix from claims arising from exchanges between users.
7. Family sharing
When you join a family, the other members can see your library, shelves, and notes, and can add your books to their own library. Invite only people you know, and invite them only with their permission. The person who creates a family manages its members. You can leave a family at any time.
8. Acceptable use
You agree not to:
- access the Service by automated means such as scraping, bots, or bulk data collection;
- reverse engineer, disrupt, or overload the Service, or try to get around its security;
- impersonate anyone;
- create accounts to evade a ban;
- use the Service to send unsolicited messages or advertising;
- use the Service in violation of any law.
9. Intellectual property
The Service, including the Librix name, logo, design, and software, belongs to Librix and its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use, in line with these Terms and the rules of the app store you downloaded it from. Book titles, cover images, and other metadata belong to their respective rights holders.
If you believe content on Librix infringes your copyright, email support@librix.app with the following:
- a description of the work;
- the location of the content in the app;
- your contact details;
- a statement that you have a good-faith belief the use is not authorized, and that your notice is accurate.
10. Third-party services
The Service relies on third-party services, such as Google Sign-In, map providers, and book data sources. Your use of those services may be subject to their own terms, and we are not responsible for them.
11. Changes and availability
We may add, change, or remove features, and we may suspend or discontinue the Service. We will try to give reasonable notice of significant changes but cannot guarantee that the Service will always be available or free of errors.
12. Termination
You may stop using Librix and delete your account at any time. We may suspend or terminate your account if you break these Terms or the Community Guidelines, if we are required to by law, or if your use creates risk for other users or for us. Sections 4 (only the license covering content already shared with others), 6, 9, and 13 to 15 survive termination.
13. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that book information will be accurate.
14. Limitation of liability
To the fullest extent permitted by law:
- Librix will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service or from your dealings with other users.
- Our total liability for any claim is limited to EUR 50. Because the Service is free, this is the greater of the amount you paid us in the past 12 months and EUR 50.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence. Nothing in them affects your statutory rights as a consumer.
15. Indemnity
To the extent permitted by law, you agree to indemnify Librix against claims, losses, and costs, including reasonable legal fees, arising from Your Content, your exchanges with other users, or your breach of these Terms.
16. App Store and Google Play terms
If you downloaded Librix from Apple's App Store:
- These Terms are between you and Librix only, not Apple. Librix, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Librix, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection and privacy claims, and intellectual property infringement claims.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded Librix from Google Play, Google's terms of service for Google Play also apply to your download.
17. Governing law
These Terms are governed by the laws of the country where Librix is established, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring claims in your local courts. Before starting a formal dispute, please contact us so we can try to resolve it informally.
18. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms. If you do not agree, you may delete your account.
19. General
- If any provision of these Terms is found unenforceable, the rest remain in effect.
- If we do not enforce a right, we have not waived it.
- You may not transfer these Terms without our consent. We may transfer them as part of a merger or sale of assets.
- These Terms, the Community Guidelines, and the Privacy Policy are the entire agreement between you and Librix about the Service.
